Former Duke University bariatric surgeon Dr. Eric DeMaria and former Duke employment John Cotton have been charged with embezzling more than $250,000 from the University.
Conclusion to this case: All charges were thrown out by the district attorney as having no merit. The arrest was made by duke police (not the real police) in an apparent retaliation for the doctor leaving Duke to start his own practice; a practice that would compete head-on with the duke hospital. The doctor is an exceptional surgeon. I hope he sues Duke for millions.
Karma may be at play in this case… I find it interesting that the anniversary of my husband’s death was the same day Dr. DeMaria was charged. I guess he would have long forgotten a patient that died at his hands. And, forget trying to build a case against him. He is too connected for anyone to challenge him. But sometimes justice comes slowly, and even when it seems it has not, it will come eventually!
why would any business contiune to pursue something that the District ATTORNEY REFUSED TO LOOK AT BECAUSE IT HAD NO MERRIT? dUKE EXECUTIVE SHOULD BE FIRED FOR LETTING EGO GET AHEAD OF WHAT IS RIGHT AND LEGAL. i WONDER IF dUKE EVER WROTE AN APPOLOGY FOR WHAT THEY DID BUT OF COURSE WE KNOW hOSPITALS NEVER ADMIT TO THEIR MISTAKES DO THEY..
hAVING DELT WITH THE dUKE WEIGHT LOSS CENTER BEFORE dR. dEMARIA TOOK OVER i KNOW JUST HOW MUCH THEY THINK OF THEM SELVES AND THAT WAS THE RESON i GOT TIRED OF A RUN AROUND AND WENT SOME WHERE ELSE.
i BELIEVE THEY FOUND ONE 300.00 CHECK THAT WAS MISCLASSIFIED AFTER IT WAS ALL SAID AND DONE. BOTH GENTLEMEN DID NOTHING WRONG AND HAVE WAY MORE CLASS THEN dUKE hOSPITAL’S EXECUTIVE STAFF
The charges did have merit and Elite status and preference was granted. ED entered into a deferred prosecution agreement which required ED to be placed on unsupervised probation for 12 months and perform 300 hours of pro bono community service at a not-for-profit medical facility providing medical care to the indigent. Then the charges would be dismissed.

300 hours is basically to work for free full time for one year. Far from thrown out with no merit. Lots of merit. Just negotiated to compensate with free work vs. jail time.
